The City Commission has adopted an alternative code enforcement system, utilizing a Special Magistrate, to provide an equitable, expeditious, effective, and inexpensive method of enforcing any codes and ordinances in force in the City.
The Special Magistrate is appointed by the City Commission to hear cases brought by code officers for violations of any city ordinances or the City Code and any county code or state statute incorporated into the City Code by reference or by operation of law occurring within the City of Margate. The Special Magistrate has the authority to assess fines and enforcement costs against violators. It also has the authority to notify the administration and to order same to make reasonable repairs necessary to bring properties in compliance, charging the violator with the reasonable cost of repairs, or where it is determined that a violation presents a serious threat to the public health, safety, or welfare, or the violation is irreparable or irreversible in nature.
The Special Magistrate hearings are held on the fourth Tuesday of each month in Commission Chambers, with the exception of December, when it is changed to the third Tuesday to accommodate the holiday.
